Kurbani Durjini Ltd. Diamond Sales Policy

This policy outlines the terms and conditions governing the sale of diamonds by Kurbani Durjini and establishes clear guidelines regarding the verification process, customer responsibilities, and the limitations of our liability. By purchasing a diamond from Kurbani Durjini, the customer acknowledges and agrees to the following terms, which are designed to protect both the customer and Kurbani Durjini.

  1. Verification and Authentication Procedures

Kurbani Durjini is committed to providing high-quality diamonds. To this end, we undertake reasonable measures to authenticate and verify the diamonds we sell. These measures include, but are not limited to:

  • Internal Inspection: All diamonds sold by Kurbani Durjini are subject to a thorough examination by our team of qualified gemmologists. This examination assesses the diamond’s physical characteristics, including but not limited to carat weight, cut, clarity, and colour.
  • Third-Party Certification: Where available, diamonds may be accompanied by certificates issued by independent and internationally recognized gemmological institutions (such as the Gemmological Institute of America (GIA), International Gemmological Institute (IGI), or American Gem Society (AGS)). These certificates provide an independent evaluation of the diamond’s quality. However, Kurbani Durjini cannot be held responsible for any inaccuracies or errors contained in third-party certification reports.
  • Disclosure of Treatments or Enhancements: If a diamond has undergone any treatment, such as clarity enhancements or colour alterations, this information will be disclosed to the customer at the point of sale. Customers are responsible for understanding the nature of such treatments and their potential impact on the diamond’s value.
  1. Limitation of Liability

While Kurbani Durjini Ltd. takes all reasonable steps to ensure the authenticity of the diamonds we sell, we expressly disclaim any and all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • No Absolute Guarantee: Kurbani Durjini cannot and does not guarantee the authenticity of any diamond sold without third-party certification. In such cases, the customer agrees to purchase the diamond as-is, without any representation or warranty as to its authenticity, origin, or untreated nature.
  • Third-Party Certificates: Any certification provided with a diamond is the sole responsibility of the issuing laboratory. Kurbani Durjini makes no representations regarding the accuracy, reliability, or completeness of any third-party certificate. In the event of a dispute regarding a certificate’s findings, the customer’s sole recourse shall be against the issuing entity, not Kurbani Durjini.
  • Treated and Synthetic Diamonds: Customers purchasing treated or synthetic diamonds will be informed of these characteristics at the time of sale. Kurbani Durjini is not liable for any claims regarding the disclosure of treatments or the synthetic nature of diamonds once this information has been provided.
  • No Warranty of Future Value: Diamonds may fluctuate in value over time due to market conditions. Kurbani Durjini makes no representations or guarantees regarding the future market value of any diamond sold, and we disclaim any liability for any depreciation in value.
  1. Final Sale and Non-Refundable Transactions

All diamond sales by Kurbani Durjini are final. No returns, exchanges, or refunds will be granted after the sale has been completed. By completing a purchase, the customer acknowledges the following:

  • They have had the opportunity to inspect the diamond and review any documentation provided.
  • They have been informed of any treatments or enhancements, as applicable.
  • They understand and accept that Kurbani Durjini disclaims all responsibility for the diamond’s future value, condition, or characteristics once the sale is concluded.
  • They release Kurbani Durjini from any and all claims, demands, liabilities, or disputes related to the diamond’s authenticity, quality, or value post-sale.
  1. Customer Due Diligence and Independent Verification

Kurbani Durjini strongly encourages customers to undertake their own due diligence before purchasing any diamond. This may include:

  • Independent Appraisal: Customers are advised to seek an independent appraisal or verification of the diamond from a certified gemmologist not affiliated with Kurbani Durjini We support this approach to provide additional peace of mind.
  • Review of Third-Party Documentation: Any certificates or appraisals provided with the diamond should be carefully reviewed by the customer prior to purchase. Kurbani Durjini assumes no responsibility for the accuracy or completeness of third-party reports.
  1. Synthetic and Lab-Grown Diamonds

Kurbani Durjini Ltd. may offer synthetic or lab-grown diamonds for sale. Such diamonds will be clearly identified and disclosed to the customer at the time of sale. Customers purchasing synthetic diamonds acknowledge the following:

  • Disclosure of Synthetic Origin: Synthetic diamonds are man-made and are not of natural origin. These diamonds may have a different market value and resale potential compared to natural diamonds.
  • No Warranty of Market Value: Kurbani Durjini makes no guarantees regarding the resale value or market demand for synthetic diamonds and shall not be liable for any losses or depreciation in value following the sale.
  1. Release of Liability

By purchasing a diamond from Kurbani Durjini, the customer expressly agrees to the following release of liability:

  • Release of Liability for Authenticity: The customer releases Kurbani Durjini from any and all claims related to the authenticity, origin, or quality of the diamond once the sale has been completed. The customer accepts the diamond as-is and agrees that they have had sufficient opportunity to verify its authenticity to their satisfaction.
  • No Recourse for Third-Party Errors: In the event that a third-party certification or appraisal is found to contain inaccuracies, the customer’s sole recourse is against the certifying entity. Kurbani Durjini bears no responsibility for errors or omissions in third-party documentation.
  1. Governing Law and Dispute Resolution

This policy shall be governed by and construed in accordance with the laws of England & Wales. Any disputes arising under or related to this policy shall be subject to the exclusive jurisdiction of the courts located in England & Wales.

In the event of any legal dispute, the customer agrees that Kurbani Durjini’s maximum liability shall be limited to the purchase price of the diamond, and in no event shall Kurbani Durjini be liable for any indirect, incidental, or consequential damages.

While we take all reasonable steps to verify the authenticity and quality of the diamonds we sell, we cannot guarantee absolute authenticity, and we disclaim any liability for disputes that arise after the point of sale. His story of metamorphosis is very similar to that of a diamond – transformed from raw, rough carbon into a precious, ravishingly refined gem. ‘I have always been fascinated and mesmerised by diamonds,’ he says; ‘I remember looking at them, studying them closely to understand their purity, and the way they had been cut. It was an inherent feeling that has turned in to a lifelong passion. On his journey for his passion for precision and fine eye to detail has translated to jewellery. Durjini founded his first company at the tender age of 21, when he began working alongside a more experienced jeweller. ‘I suggested we set up in business and we formed a partnership, repairing western jewellery.’ Durjini’s entrepreneurial flair, opportunistic nature and courage in taking risks all contribute to his business trajectory.
