Scope of Services

1.1. The Designer agrees to create and deliver Computer-Aided Design (CAD) files, models, renderings, and related design outputs (“the Designs”) as requested by the Client.
1.2. The Designer’s services are limited to digital design work only and do not include manufacturing, material sourcing, or physical production unless expressly agreed in writing.

Ownership and Intellectual Property

2.1. Full Ownership: All intellectual property rights, copyright, and design rights in the CAD files, sketches, models, renderings, and related creations produced by the Designer remain the sole property of Kurbãni Durjini Ltd, whether preliminary, draft, or final.
2.2. The Client is granted a non-transferable, non-exclusive licence to use the Designs solely for the purpose for which they were commissioned (e.g., production of a specific jewellery piece).
2.3. The Client may not copy, resell, share, modify, reproduce, or distribute the Designs or any derivative works without the prior written consent of the Designer.
2.4. Any unauthorised use, sharing, or reproduction of the Designs constitutes a breach of contract and intellectual property infringement, for which Kurbãni Durjini Ltd reserves all legal rights and remedies.

Confidentiality and Non-Disclosure

3.1. Both Parties agree to maintain confidentiality regarding all proprietary information, sketches, CAD files, and trade secrets shared during the course of this project.
3.2. The Client shall not disclose, share, or allow access to any design files or concepts to third parties, including manufacturers or competitors, without the Designer’s written permission.
3.3. The Designer retains the right to use the Designs for portfolio, marketing, or promotional purposes unless the Client requests otherwise in writing before project commencement.

Liability and Indemnity

4.1. The Designer provides design services on a best-effort basis and shall not be liable for:

• Manufacturing or production errors,

• Misinterpretation or misuse of the Designs by third parties,

• Losses, damages, or claims resulting from production, sale, or use of items based on the Designs.
  4.2. The Client agrees to indemnify and hold harmless Kurbãni Durjini Ltd and its employees from any and all claims, damages, or expenses arising from the Client’s use or modification of the Designs.
  4.3. No warranty, express or implied, is given as to the commercial viability, safety, or marketability of the Designs.

Payment and Deliverables

5.1. The Client agrees to pay all fees as quoted by the Designer before release of final design files.
5.2. All payments are non-refundable once design work has commenced.
5.3. Delivery timelines are estimates and may vary based on design complexity and revision requests.

Termination

6.1. Either Party may terminate this Agreement by written notice.
6.2. Upon termination, all rights in the Designs remain the exclusive property of Kurbãni Durjini Ltd.
6.3. The Client shall not use any incomplete or draft Designs without the Designer’s consent.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of London, UK.

This document constitutes the entire agreement between the Parties and supersedes all prior communications or understandings.

Limited Lifetime Warranty Policy

Kurbãni Durjini is devoted to creating jewelry that will become beloved possessions and will last for years. To ensure our clients can trust in the quality of their investment, we offer a limited lifetime warranty covering all our jewelry. We stand by each of the pieces we craft, guaranteeing that all our jewelry is free of any manufacturing flaws at the time of delivery; should any arise, repair will be free.

With a lifetime of protection, we are committed to upholding your jewelry investment on both ends. You'll have peace of mind knowing that we will do everything in our power to help you with any and all issues that might arise.

Our warranty only applies if the repair is performed by Kurbãni Durjini Jewelry. If a jewelry store other than ours repairs your jewelry, the warranty will be void and the product will no longer have any protection.

The following are examples of common jewelry issues that would NOT be considered a manufacturing defect:

• The discoloration of precious metals is caused by being in contact with make-up, lotions, chemicals, and alcohol. We recommend removing your jewelry when you are going into a pool, hot tub, or bathing.
• Metal or prongs that was worn down from wear and tear that require restoration work.
• Prongs coming loose, catching on clothing, worn out, or distortion of metal over time due to everyday wear or normal damage, allowing a diamond to fall out.
• The loss of a diamond is caused by damage from everyday wear or from other damage.
• Negligence to your jewelry weather it may be accidental or intentional damage to our jewelry.
